1. Intellectual Property & Digital Prints Usage
1.1 Ownership: All intellectual property rights, including copyright, in all digital prints, reproductions, and original source artworks (the "Artwork") available on this Website remain the sole and exclusive property of Michelle J Bruce (the "Artist").
1.2 Personal Ownership Only: The purchase of an Artwork grants the Buyer ownership of that specific physical piece of media. It does not transfer any copyright, reproduction, or commercial exploitation rights to the Buyer.
1.3 Prohibited Actions: The Buyer strictly agrees that they shall not:
(a) Digitalise, photograph, scan, or duplicate the Artwork into any digital format;
(b) Reproduce, print, or create derivative physical or digital works based on the Artwork;
(c) Use the Artwork, or any digital facsimile thereof for any commercial purpose, advertising, or resale;
(d) Claim authorship of the underlying Artwork or design.
2. Right to Cancel and Returns
2.1 Standard Made-to-Order Prints: Under the UK Consumer Contracts Regulations, Buyers residing in the UK and EU have the right to cancel their purchase of an Artwork within fourteen (14) days from the day after delivery.
(a) To exercise this right, the Buyer must notify the Artist in writing within the 14-day window.
(b) The Buyer must return the print undamaged, unused, and in its original rolling tube or flat packaging at their own expense using a fully tracked and insured shipping service.
(c) A full refund for the product and standard outward delivery will be issued within 14 days of the Artist safely inspecting the returned print.
2.2 Custom and Bespoke Prints Exemptions: Any Artwork produced to unique, non-standard specifications provided by the Buyer (including custom border crops, customer-provided text personalisation, or bespoke framing options) are strictly exempt from the 14-day cancellation right under statutory law. These items are non-refundable unless they arrive structurally defective or damaged in transit.
2.3 Transit Damage: In the event that an Artwork is damaged during international or domestic transit, the Buyer must notify the Artist within 48 hours of delivery, providing clear photographic evidence of both the packaging and the print to qualify for a free replacement print.
2.4 International Import Customs: For prints shipped outside the United Kingdom, the Buyer is considered the importer of record. The Buyer is solely responsible for paying any local import VAT, custom tariffs, clearing fees, or duties levied by their destination country upon arrival. The Artist is not liable for international transit delays held up by local customs offices.
